El Day Tour is a registered brand of SoySur Travel Group. We design and sell tours in Ecuador and deliver them together with carefully selected local partners. By booking with us, you accept these Terms & Conditions and our Booking, Payment & Cancellation Policy. Please read both before you book.
El Day Tour is your contact and the company you book with. We plan the tours, sell them, confirm your booking, and handle your questions before, during and after your trip.
We are responsible for what we promise you: accurate tour descriptions, correct bookings, clear communication, and selecting properly licensed and insured partners. Our partners are responsible for the safe, professional delivery of the service on the day in our name. Each party is responsible within its own area.
These terms apply to everyone in your booking. If you book for other people, you confirm that you have their permission and that you have shared these terms with them. You are responsible for the payment and for the accuracy of the information given for every participant.
Your booking is confirmed as soon as your payment is completed.
In rare cases we may need to cancel or modify a confirmed booking — for example if the date is unexpectedly full, if a price or tour detail was displayed incorrectly, or if the tour cannot be run safely for you based on the information you have given us. If this happens we will contact you as soon as possible to define a suitable solution.
You confirm that the information you give us is true and complete. We pass on the details our partners need to run your tour safely, including relevant health information.
If you do not tell us about a relevant health condition or limitation, we and our partners cannot prepare for it. In that case we are not responsible for problems that arise from it, and we reserve the right to end your participation on the day without a refund if it is unsafe for you to continue.
If you are unsure whether a condition is relevant, tell us. We would rather know.
Travel insurance. We strongly recommend comprehensive travel insurance covering medical treatment, emergency evacuation and trip cancellation. Medical care in remote areas of Ecuador is limited and evacuation can be expensive.
Participants under 18 must be accompanied by a parent or legal guardian, who is responsible for their supervision and conduct throughout the tour. Some tours have minimum ages for safety reasons — these are stated on the tour page. Please contact us before booking if you are not sure and travelling with children.
Our tours take place outdoors and often in remote parts of Ecuador. No tour operator can remove every risk from this kind of travel. By booking, you accept the ordinary risks that come with the activities you have chosen. You take part voluntarily and at your own risk.
Serious injury and death are always a possibility. We cannot accept responsibility where this results from environmental situations, from your own actions, from a health condition you have, or from any cause outside our control. Please travel with insurance that covers medical treatment, emergency evacuation and repatriation.
We are responsible for:
- describing our tours accurately, including difficulty, duration and altitude
- confirming your booking correctly and on the dates agreed
- selecting partners who hold valid Ecuadorian tourism licences and current insurance
- passing your relevant health and access information to the partner delivering your tour
- telling you promptly about cancellations, delays or significant changes
- handling your payment and any refund correctly
- helping you resolve problems that arise during your tour
We are not responsible for:
- loss, theft or damage to your personal belongings
- injury or loss caused by your own actions, including ignoring safety instructions
- delays, cancellations or changes caused by weather, road conditions, traffic, strikes or the acts of authorities
- costs you incur outside the tour
- services you arrange yourself with third parties
Keep your belongings with you and secure. Do not leave valuables unattended in vehicles or public areas. Travel insurance is the only protection for loss or theft.
Your guide is responsible for the group's safety and has authority over how the day runs. Guides may change the route, shorten an activity, or stop the tour if conditions require it. You must follow their instructions.
We may end your participation, without a refund, if you:
- ignore safety instructions after being asked to follow them
- are under the influence of alcohol or drugs
- behave in a way that threatens, harasses or endangers others
- damage property or break Ecuadorian law
If your participation ends this way, you are responsible for your own return transport and any costs that follow.
Many of our tours visit national parks, protected areas and indigenous community land. You agree to:
- take your waste with you
- stay on marked paths
- leave plants, rocks and archaeological material where they are
- keep your distance from wildlife and never feed wild animals
- follow your guide's instructions and respect local rules and customs
Ecuadorian authorities can fine individuals for breaking environmental rules. Those fines are your responsibility.
Tours run in a natural environment and conditions can change. Routes, stops, timings and guides may change for reasons of weather, safety, access or availability. We will tell you about significant changes as early as we can.
We and our partners sometimes take photographs and videos on tour for our website and social media. Tell your guide at the start of the day if you do not wish to appear, and we will respect that. If a photograph of you is already published and you want it removed, email us and we will remove it.
If something is wrong during your tour, tell your guide immediately. Most problems can be solved on the spot, and we cannot fix a problem we do not know about.
If it is not resolved, contact us immediately within 24 hours of your tour, with your booking reference and a description of what happened. We will acknowledge and give you a full response to your complaint within 2 working days.
Name, contact details, passport details, date of birth, emergency contact, payment information, health information you give us, and your preferences and requests.
To confirm and deliver your booking, to communicate with you, to meet Ecuadorian tourism and tax obligations, and — only if you have agreed — to send you marketing.
The local partner delivering your tour, and only what they need to run it safely. Our payment providers. Insurers and emergency services if there is an incident. Authorities where the law requires it. We do not sell your personal data.
Booking and financial records for 7 years, as Ecuadorian tax law requires. Health information is deleted after your tour unless we need it for an ongoing incident or claim. Marketing contact details until you unsubscribe.
You can ask us for a copy of your data, ask us to correct or delete it, withdraw consent for marketing, or object to how we use it.
We use encrypted connections and restricted access. In the unlikely event of a hacking event and if a breach affects your data we will inform you promptly.
We may update these terms from time to time. The current version is always the one published on our website.
Changes never apply to bookings already made. Your booking is governed by the terms in force on the day we confirmed it. If you want a copy of those terms, ask us and we will send them.
These terms are governed by the laws of Ecuador.
Where we are liable, our liability is limited to the amount you paid us for the affected tour, except where the law does not permit that limit.
If you have a dispute with us, please write to us first at ecuador@eldaytour.com so we can try to resolve it directly. We will respond within 30 days.
If we cannot resolve it, either of us may propose mediation before taking any other step. Mediation is voluntary and either side may decline.
If the dispute is still unresolved, it may be brought before the competent courts of Quito, Ecuador.
If any part of these terms is found to be invalid or unenforceable, the rest remains in force, and that part will be applied in the way closest to its original intention that the law allows.
